1. Terms

By accessing the website at https://unicornplatform.com and its pages, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

1. About unHR

  • unHR provides fractional HR services to startups and SMEs across India. Our services include but are not limited to HR strategy, hiring support, policy creation, employee engagement, performance management, HR tech implementation, and compliance support.
  • 2. Eligibility

  • By using our Services, you represent that you:
    1. Are at least 18 years old;
    2. Are legally capable of entering into a binding agreement;
    3. Are using the Services on behalf of a company or legal entity with the authority to bind that entity.

    3. Scope of Services

    Our services are provided on a retainer, project, or per-hour basis, as per the signed agreement or service contract with each client. The specific scope, timelines, and deliverables shall be outlined in the respective Service Agreement .

  • We do not guarantee hiring outcomes, candidate performance, or legal immunity from HR-related disputes unless explicitly stated in the signed agreement.

    4. Payment Terms

    1. All payments must be made as per the agreed terms in the invoice or contract.
    2. Payment delays may result in service suspension or termination.
    3. All fees are non-refundable unless otherwise agreed upon in writing.
    4. GST and other applicable taxes shall be charged as per Indian law.

    5. Confidentiality

    We respect your confidentiality and expect the same from our clients. Both parties agree to protect each other’s confidential information shared during the engagement. Confidential information shall not be disclosed to any third party without written consent unless required by law.

    6. Compliance with Indian Laws

  • unHR complies with all applicable Indian laws including but not limited to:
    1. Labour Laws (e.g., The Factories Act, Shops & Establishments Act)
    2. IT Act, 2000 and its amendments (for data protection)
    3. GST Act
    4. POSH Act, 2013 (Prevention of Sexual Harassment at the Workplace)

    Clients are responsible for ensuring that their internal operations comply with Indian labour and employment laws.

    7. Intellectual Property

    All content, documents, and tools developed by unHR during the engagement remain the intellectual property of unHR unless otherwise agreed upon.

    Clients are granted a non-transferable, non-exclusive right to use deliverables for internal use only.

    8. Limitation of Liability

  • unHR shall not be liable for:
    1. Any indirect, incidental, or consequential damages.
    2. Employee actions or misconduct post-recruitment.
    3. Third-party vendor failures (e.g., background check services, payroll tech platforms).

    Total liability under this agreement shall not exceed the amount paid by the client for the services in question.

    9. Termination

  • Either party may terminate the agreement with written notice, subject to the termination clause in the Service Agreement. In the event of termination:
    1. Outstanding dues must be cleared within 7 working days.
    2. All unutilized service hours will lapse unless otherwise agreed.

    10. Data Privacy

    We collect limited personal and business information solely to offer better services. By using our Services, you agree to our Privacy Policy. unHR does not sell, rent, or trade your data.

    We may use your anonymised data for research, benchmarking, and service improvement.

    11. Third-Party Tools

    We may use third-party platforms (e.g., Zoho People, Slack, WhatsApp) to deliver parts of our services.

    We are not liable for the performance or data breaches caused by these tools.

    12. Dispute Resolution

    1. Both parties will attempt amicable resolution.
    2. If unresolved, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with one arbitrator mutually appointed.
    3. Jurisdiction: Courts of New Delhi, India.

    13. Updates to Terms

    unHR reserves the right to update these Terms at any time. Updated terms will be posted on our website and will be effective upon posting. Continued use of our services implies acceptance of the revised Terms of Service.
